NEW YORK —The drugmaker Pfizer has agreed to pay $75 billion to settle lawsuits claiming the painkiller has caused heart attacks and other serious health problems. The government has not disclosed the amount. The company said it will pay a $2.5 billion settlement. The company said the settlement includes a $6 billion payment by its employees.
The settlement includes more than $1 billion in payments by its employees, the companies said. That amount was included in the amount reached last month by the New York attorney general's office.
The drug maker said its largest lawsuit was in 2015, when it filed for a class-action lawsuit against Pfizer alleging that it had engaged in a marketing fraud and deceptive business practice. The New York attorney general's office said the settlement is expected to be paid by the company by the end of the year.
The lawsuits, which were filed in federal court, allege that Pfizer's marketing practices caused a heart attack and a heart attack in 2004. The company, which makes Celebrex, pleaded guilty in September 2012 to the federal marketing fraud charges and agreed to pay a $5 billion fine and a $4.9 billion settlement. It will pay an additional $1 billion in damages.
The suit was filed in federal court in New Jersey and involved nearly $5 billion in damages, including a $1.3 billion settlement. The companies also have settled with several states, including New York, which has taken legal action against Pfizer and related pharmaceutical companies.
The New York attorney general's office said the settlement resolves allegations that the company and its executives have been misleading consumers and selling false information to doctors.
It is the first time the company has reached a settlement over a class-action lawsuit.
The suit was filed on April 10 and is a suit filed in state court in Delaware and brought by a plaintiff in federal court in Brooklyn. The complaint alleges that Pfizer made false, misleading and deceptive marketing claims to doctors.
In a settlement statement, Pfizer, Inc. said, "Pfizer is committed to vigorously challenge the Company's conduct in this matter and to pursue appropriate enforcement actions to ensure the integrity of the Company's business. We will pay any and all costs and expenses related to this litigation related to the successful resolution of this case."
The settlement includes $5 billion in payments by Pfizer to its employees, the companies said. Pfizer said the settlement is expected to be paid by the end of the year.
The New York attorney general's office said the company has not agreed to settle the suit.
The government was the first to file a new lawsuit against the pharmaceutical industry, and in October 2015, it filed for a class-action lawsuit against the drug maker. The government has filed a third-party lawsuit alleging that the drug maker did "promulge, directly or indirectly, false and misleading statements and information about physicians, consumers, health care providers, and patients about Celebrex and other pain-relief drugs, including other non-steroidal anti-inflammatory drugs, and other products and drugs that were used to treat arthritis."
The suit claims that the company's marketing of Celebrex, a COX-2 inhibitor, led to a heart attack and a heart attack in 2004.
In the first suit, Pfizer says, the company did not disclose any of its products to doctors and doctors did not adequately warn consumers about the risks.
The company also says that Celebrex "promises or indicates that it is a safe and effective treatment for osteoarthritis or rheumatoid arthritis," which it claims is caused by its COX-2 inhibitor.
In the second suit, the company says that it did not adequately warn consumers about the dangers of using Celebrex to treat arthritis or other pain.
In addition, the company says, "Pfizer is a leader in the treatment of serious medical conditions, including osteoarthritis, acute myocardial infarction, acute exacerbation of chronic obstructive pulmonary disease, and chronic kidney disease."
The first and second suits also allege that Pfizer and its doctors knew of the dangers of Celebrex and were aware of the risks and took corrective measures.
